Certificate of final approval
The Certificate of Final Approval is vital for property buyers. It provides the only independent, professional inspection of the property throughout the entire course of its construction. The independent inspection ensures that the property has been built in accordance with the Town Planning Permissions, planning and building permits issued for its construction. As a buyer it gives the property the authority's seal of approval that:
What you are getting is what you have paid for - the room sizes and dimensions are as shown on the approved plans, the property has been located on the ground & built correctly and things such as balcony safety railings, wall heights, swimming pools, have been constructed in accordance with building regulations.
Green areas, car parking, lighting and other communal areas have been correctly incorporated into the development as agreed with the authorities.
Until such time as the authorities have inspected the development and issued it a 'Certificate of Final Approval', the developer cannot apply to to the Land Registry for the issue of Title Deeds for the individual properties comprising the development.
We are aware that many property buyers have inadvertently broken the law and are living in property that has yet to be inspected and receive this certificate of approval. Can you please help us quantify the scope and scale of this problem.
If you bought a new property for which no Title Deed was available at the time of its purchase, can you please let us know:
Did your lawyer advise you that your property had been independently inspected and approved by the authorities? If not, did he/she advise you of the risks associated with taking delivery of a property that had not been inspected and approved?
When you took delivery of the property.
The District in which the property is situated.
The name of the property developer from whom you bought the property (if applicable).
The name of the lawyer or law firm you used when you bought the property.
